Peanut Butter Danger Speads To 491 Infected Persons

The food poisoning outbreak related to Salmonella keeps getting larger and larger. According to the the United States Center for Disease Control (CDC) there are now 491 reported cases of people infected with the outbreak strain of Salmonella Typhimurium. have been reported from 43 states and Canada. The illness is very broad with reported peanut butter related infections in the elderly and children, and infecting men and women about equally. This is a very serious infection. Already seven deaths are reported to be related to the peanut butter infection. According to the CDC:

Among the persons with confirmed, reported dates available, illnesses began between September 14, 2008 and January 8, 2009. Patients range in age from <1 to 98 years; 48% are female. Among persons with available information, 22% reported being hospitalized. Infection may have contributed to seven deaths.

Some may wonder what the legal remedies are for persons infected from the peanut butter salmonella outbreak. Essentially in Florida product liability laws govern the claims related to food poisoning ingestion from food products. Most product liability claims fall under two legal claims: negligence and strict liability. Negligence claims will require proof that the peanut butter manufacturer, supplier, seller or distributor was breached the appropriate standard of care in the storage, manufacture or transport of the peanut butter that caused the infection from salmonella contained within the peanut butter. Strict liability claims hold everyone in the chain of distribution of the infected peanut butter--manufacturers, suppliers, and even retail sellers of the product (the Walmarts, Publix etc..) for the sale of an unreasonably dangerous product. Because infected peanut butter is unreasonably dangerous and because the exact source of the contaminations are still being evaluated the strict liability product liability claim is essential to these the succesful pursuit of a peanut butter salmonella related injury or death claim.

Peanut Butter Salmonella Outbreak Discovered in Kellogg Crackers

The salmonella contamination that was reported last week by the FDA has now been found in a package of Kellogg's brand Austin Quality Foods Toasty Crackers with Peanut Butter.

Peanut paste and peanut butter is suspected to be the source of a salmonella outbreak that is responsible for 6 deaths, hospitalization of at least 90, and another 470 related illnesses.

While federal officials believe most peanut butter sold in jars at grocery stores is safe, the FDA is recommending that consumers refrain from eating cookies, cakes, ice cream and now apparently peanut butter crackers. You can find a complete list of the brands on the FDA's website.

This current outbreak is just one of a long list of salmonella food contaminations reports from the FDA and CDC in the past 12 months. Previously, there was concerns of contamination in pot pies, pet food, spinach, and cantalopes, just to name a few.

FDA: Peanut Butter Problem Worse than Previously Believed

Since the first outbreak of the Peter Pan peanut butter recall, the news has only become worse. Now, the FDA is saying the peanut butter contamination poses more of a health risk than previously thought. The group has also said it would increase monitoring and investigation of plants that process peanut butter. The FDA has not decided whether it will sanction ConAgra, the processor of the Peter Pan peanut butter.

Carvel and Sonic Hit by Peanut Butter Recall

The same peanut butter that was recalled a few weeks ago due to salmonella contamination is now being linked to peanut butter used in Carvel Ice Cream stores and Sonic restaurants. This peanut butter had been shipped from the ConAgra plant in Sylvester Georgia to its sister plant in Humboldt Tennessee where the peanut butter is sold to Carvel and Sonic. According to the FDA, the topping was used in the following Sonic products:

Peanut Butter Shake,
Peanut Butter Fudge Shake,
Peanut Butter Sundae,
Peanut Butter Fudge Sundae.
The topping was used in the following Carvel ice cream products:

Chocolate Peanut Butter,
Peanut Butter Treasure,
Peanut Butter and Jelly,
Reeses Peanut Butter Cup Sundae Dasher

Peanut Butter Contamination Recall Broader than First Thought

The FDA has expanded its warning concerning Peter Pan peanut butter recall. Initially, the warning advised consumers to discard peanut butter jars with the product code of 2111, but now it has advised consumers to throw out all Peter Pan peanut butter jars that were purchased after May 2006. However, we're advising our clients and those consumers who contact us to hold onto the jars if they've eaten the peanut butter and became sick. Children Especially at Risk from Peanut Butter

We all know peanut butter & jelly sandwiches are a staple for our kids. The recent recall of Peter Pan & Great Value peanut butter is especially worrisome for parents and children. Children are at an increased risk of serious illness due to this foodborne illness. Recent experience with e coli and hamburgers and spinach have demonstrated how deadly foodborne illness are to children. Beware of the following symptoms which can mask salmonella poisoning: fever, vomiting, dehydration, and diarrhea. It's a scary day when an ordinary peanut butter & jelly sandwich poses such a risk for our children.

Florida Gets Peanut Butter Contamination Cases

I received two calls this afternoon, one from a local Florida person who has been stricken with food poisoning from contaminated peanut butter. The principal cause of the foodborne illness with the peanut butter is salmonella which started showing up in August 2006. The peanut butter in question has been processed at the ConAgra Foods plant in Sylvester, GA and the brand names to be wary of are Peter Pan and Great Value.

Peanut Butter Recalled After Salmonella Found

Federal health officials have recalled two brands of peanut butter because the product has been linked to a salmonella outbreak. Peter Pan and Great Value peanut butter brands beginning with a product code "2111" were being removed from store shelves yesterday. The salmonella outbreak, which began last August, has been linked to peanut butter produced by ConAgra Foods in a plant in Sylvester, GA.
